have purchased 37" and ran about 1000km offroad km's without any truble and decided to try 40" nitto mud grapplers for a bit more hardcore offroading. in few days, i bent front lower arm, ti-rod, drag link and all steering geometery. + 2 of rear fox shocks. yes that all on 200km of crawling.
If your pocket has a very very deeeeeeep hole with credit card bill all paid off to start fresh, then i'd still go with 40" tires.
now, 2013 jeep has no warrenty papers with axles swapped, long arm conversion, and so on. Thanks to 40" tires my long arm sure feel much smoother + king coilover does what it should do!
but i'd stick to 37" if you never felt that bigger tires would help you to go around trails. 40" sure looks good but never ending breakage in the bush and your bank.
